Root causes of high costs

A wide range of federal, state, and local government policies and regulations have been blamed for raising costs, including:
• Regulations protecting costly special interests – e.g.:
‒ Certificate of need and similar regulations that protect existing competitors from new entrants
‒ Professional standards that raise the cost and restrict the supply of critical skills (e.g., physicians)
‒ Scope of practice laws that restrict the practice of mid-level professionals and keep them from operating “at the top of their license”
• Regulations that raise insurer and/or provider costs and/or hinder their efficiency
